58-3410. Prohibited claims; effect of filing.No person shall use the privilege of filing notices hereunder for thepurpose of slandering the title to land, and in any action brought for thepurpose of quieting title to land, if the court shall find that any personhas filed a claim for that reason, the court shall award the plaintiff all thecosts of such action, including such attorneys' fees as the court mayallow, and, in addition, shall decree that the defendant asserting suchclaim shall pay all damages that plaintiff may have sustained as the resultof such notice of claim having been so filed of record.
