Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 33.--KANSAS DEPARTMENT OF CIVIL AIR PATROL

      48-3303.   Expenditure of state moneys; receipt ofother moneys; patrol part of adjutant general's office for budget and personneland other state administrative processes; form of appropriation.(a) The Kansas department of civil air patrol may expendmoneys appropriated from the state general fund for the department topurchase and maintain communications systems, to pay the maintenance andinsurance costs of aircraft and vehicles owned by the department, to paynecessary operationsand administrative expenses incurred in support of the functions specifiedin K.S.A. 48-3302, and amendments thereto, and to pay salaries of necessarysecretarial or administrative support personnel, in accordance withappropriation acts. For the purpose of preparation of the governor's budgetreport, personnel actions and other actions in the state administrativeprocess, the Kansas department of civil air patrol shall be considered part ofthe adjutant general's office. Vehicles of the civil airpatrol shall be considered federal assets.

      (b)   Moneys appropriated from the state general fundto the adjutant general's office for the civil air patrol shall beappropriated as a separate line item and shall not be merged with other itemsof appropriation for the adjutant general. Such moneys shall not be expendedto procure or replace equipment which is otherwise obtainable through grants orcontributionsfrom any other source nor shall moneys appropriated from the state generalfund to the adjutant general's office for the civilair patrol beexpended for uniforms or personal equipment of any volunteermember of the department, or for the purchase of aircraft or motorvehicles, or for payment of any salaries other than salaries of necessarysecretarial or administrative support personnel.

      (c)   The head of the department for and on behalf of the department mayrequest of and accept from individuals,the United States government or any of its departments or agencies or anyother public or private body, grants or contributions of moneys orproperty which the head of the departmentmay authorize to be usedfor or in aid of any of the purposes of this act. All moneys received bythe department pursuant to this subsection shall beremitted to the state treasurer in accordance with the provisions of K.S.A.75-4215, and amendments thereto. Upon receipt of each such remittance, thestate treasurer shall deposit the entire amount in the statetreasury to the creditof the civil air patrolgrants and contributions fund.

      (d)   All expenditures of moneys from the civil airpatrol grants and contribution fund shall be made in accordance withappropriations acts upon warrants of the director ofaccounts and reports issued pursuant to vouchers approved by the head of thedepartment.
