48-238. Calling out militia.It shall be the duty of the governor, and the governor is hereby authorized andrequired, in case of war, invasion, insurrection, or breaches of the peace,or imminent danger thereof, or any forcible obstruction to the execution ofthe laws, or reasonable apprehension thereof, to call upon the nationalguard to defend the state or aid the civil authorities to enforce the lawsthereof; and when the president of the United States shall make a call orrequisition for troops, the governor shall first order into the service theorganizations of the Kansas national guard and the officers thereof, ofsuch organizations and arms of service as are specified in saidrequisition, and the governor is empowered and shall direct the respective officersthereof to recruit said organizations to conform in number to similarorganizations in the army of the United States, or as may be required insaid requisition.
