Chapter 46.--LEGISLATURE
Article 35.--JOINT COMMITTEE ON HEALTH POLICY OVERSIGHT

      46-3501.   Joint committee on health policy oversight;membership; appointment; terms; officers; quorum; meetings; duties;professional services; legislation.(a) There is hereby created the joint committee on healthpolicy oversight within thelegislative branch of state government. The joint committee shall be composedof 12 members. Sixmembers shall be members of the house of representatives and six members shallbe members of thesenate. Four of the members who are members of the house of representativesshall be appointed bythe speaker of the house of representatives, four members who are senatorsshall be appointed by thepresident of the senate, two members who are members of the house ofrepresentatives shall beappointed by the minority leader of the house of representatives and twomembers who are senatorsshall be appointed by the minority leader of the senate.

      (b)   All members of the joint committee on health policy oversight shall servefor terms of two years ending on the first day of the regular session of thelegislature commencing in the first odd-numbered year after the year ofappointment, except that the first members shall be appointed on July 1, 2005,and shall serve for terms ending on the first day of the regular session of thelegislature commencing in 2007. If a vacancy occurs in the office of any memberof the joint committee on health policy oversight, a successor shall beappointed in the same manner as the original appointment for the remainder ofthe term.

      (c) (1)   The chairperson of the joint committee on health policy oversightshall be appointed for a term of one year which ends on the first day of thenext occurring regular session of the legislature. The speaker of the house ofrepresentatives shall appoint the first chairperson on July 1, 2005, and shallappoint the chairperson for the term commencing on the first day of the regularsession of the legislature commencing in 2006 for a one-year term to end on thefirst day of the regular session of the legislature commencing in the year2007. The president of the senate shall appoint the next chairperson on thefirst day of the regular session of the legislature commencing in the year 2007for a one-year term which ends on the first day of the next occurring regularsession of the legislature. Thereafter the appointment of the chairperson shallcontinue to alternate between the speaker of the house of representatives andthe president of the senate with each subsequent chairperson being appointedfor a one-year term ending on the first day of the regular session of thelegislature in the next occurring regular session of the legislature after theyear of appointment.

      (2)   The vice-chairperson of the joint committee on health policy oversightshall be appointed for a term of one year which ends on the first day of thenext occurring regular session of the legislature. The president of the senateshall appoint the first vice-chairperson on July 1, 2005, and shall appoint thevice-chairperson for the term commencing on the first day of the regularsession of the legislature commencing in 2006 for a one-year term to end on thefirst day of the regular session of the legislature commencing in the year2007. The speaker of the house of representatives shall appoint the nextvice-chairperson on the first day of the regular session of the legislaturecommencing in the year 2007 for a one-year term which ends on the first day ofthe next occurring regular session of the legislature. Thereafter theappointment of the vice-chairperson shall continue to alternate between thespeaker of the house of representatives and the president of the senate witheach subsequent vice-chairperson being appointed for a one-year term ending onthe first day of the regular session of the legislature in the next occurringregular session of the legislature after the year of appointment.

      (3)   If a vacancy occurs in the office of the chairperson or vice-chairperson,a member of the joint committee on health policy oversight who is a member ofthe same house of the legislature as the member who vacated the office shall beappointed by the speaker of the house, if the vacating member was a member ofthe house of representatives, or by the president of the senate, if thevacating member was a member of the senate, to fill such vacancy.

      (d)   A quorum of the joint committee on health policy oversight shall beseven. All actions of the joint committee on health policy oversight shall betaken by a majority of all of the members of the joint committee.

      (e)   The joint committee on health policy oversight shall have the authorityto meet at any time and at any place within the state on the call of thechairperson.

      (f)   The provisions of the acts contained in article 12 of chapter 46 of theKansas Statutes Annotated, and amendments thereto, applicable to specialcommittees shall apply to the joint committee on health policy oversight to theextent that the same do not conflict with the specific provisions of thissection applicable to the joint committee.

      (g)   Members of the joint committee on health policy oversight shall receivecompensation, travel expenses and subsistence expenses as provided in K.S.A.75-3212 and amendments thereto when attending meetings of the joint committee.

      (h)   The staff of the legislative research department, the office of revisorof statutes and the division of legislative administrative services shallprovide such assistance as may be requested by the joint committee on healthpolicy oversight and to the extent authorized by the legislative coordinatingcouncil.

      (i)   The joint committee on health policy oversight shall have the exclusiveresponsibility to monitor and study the operations and decisions of the Kansashealth policy authority. In addition, the joint committee shall oversee theimplementation and operation of the children's health insurance plans,including the assessment of the performance based contracting's measurableoutcomes as set forth in subsection (b)(4) of K.S.A. 38-2001, and amendmentsthereto.

      (j)   In accordance with K.S.A. 46-1204 and amendments thereto, the legislativecoordinating council may provide for such professional services as may berequested by the joint committee on health policy oversight.

      (k)   The joint committee on health policy oversight may introduce suchlegislation as it deems necessary in performing its functions.

      (l)   The provisions of this section shall expire on July 1, 2013.
