42-381. Formation of districts comprising contiguous territory intwo or more counties; petition; election.That an irrigation district, for the creation of which provision is madeby K.S.A. 42-357 to 42-380, may comprise contiguous territory located intwo or more counties,and when so located or proposed to be located, all acts and proceedingsby the board of county commissioners and other county officers, asprovided in said article, shall be done and performed by the board ofcounty commissioners and other county officers of the county in whichthe greater part of the territory of such district is located orproposed to be located.
The petition for the formation of any irrigating district locatedpartly in each of two or more counties, and any petition for the holdingof an election to vote bonds of such district, must be signed by notless than three-fifths of the resident landowners of each of the severalportions of said district lying in each of the said counties; and inorder to authorize the issuance of any bonds of such district,three-fifths of the votes cast at such election in each of the severalportions of said district lying in each of said counties must be infavor of issuing such bonds.
