41-2727. Use of minors to determine compliance withlaw, exceptions.(a) Any person listed in subsections (b)(1), (b)(2) or(b)(3) may engage or direct a person under the legal age for consumption ofcereal malt beverage to violate the provisions of K.S.A.41-2701, et seq., and amendments thereto, in order to develop aprogram or system which determines andencourages compliance with the provisions thereof prohibiting thefurnishing or sale of cereal malt beverages to a person under the legal age forconsumption of cereal malt beverage or the consumption ofcereal malt beverages by such persons.
(b) No person shall engage or direct a person under the legal age forconsumption of cereal malt beverage to violate anyprovision of K.S.A. 41-2701 et seq., and amendments thereto, forpurposes of determiningcompliance therewith unless such person is:
(1) An officer having authority to enforce the provisions ofK.S.A. 41-2701 et seq., and amendments thereto;
(2) an authorized representative of the attorney general, a county attorneyora district attorney; or
(3) a licensee under the provisions of K.S.A. 41-2701, et seq.,and amendments thereto, or such licensee'sdesignee pursuant to aself-compliance program designed to increase compliance with the provisions ofK.S.A. 41-2701 et seq., and amendments thereto if such program hasbeen approved by the director.
