Article 2c.--RISK-BASED CAPITAL REQUIREMENTS

      40-2c02.   Risk-based capital report.Every domestic insurer, concurrent with or prior tosubmission of the annual statement required by K.S.A. 40-225 and amendmentsthereto, shall prepare and submit to the commissioner a report of its RBClevels asof the end of the calendar year just ended in a form and containing suchinformation as is required by the RBC instructions. In addition, everydomestic insurer shall file its RBC report:

      (a)   With the NAIC in accordance with the RBC instructions; and

      (b)   with the insurance commissioner in any state in which the insurer isauthorized to do business, if such insurance commissioner has notified theinsurer of its request in writing, in which case the insurer shall file its RBCreport not later than the later of:

      (1)   Fifteen days from the receipt of notice to file its RBC report with thatstate; or

      (2)   the filing date otherwise specified in this subsection.
