Article 11.--GENERAL PROVISIONS RELATIVE TO CASUALTY, SURETY AND FIDELITY COMPANIES

      40-1126.   Reports by insurers of health care providers of anyactions to state board of healing arts.(a) Every insurer providing professional liability insurance to a healthcare provider who islicensed, registered or certified by the state board of healing arts andcovered by the health care stabilization fund established pursuant tosubsection (a) of K.S.A. 40-3403, and amendments thereto, or entitywith whom theinsurer contracts for purposes of complying with this act shall report tothe state board of healing artsany action for damages for personal injuries or loss claimed tohave been caused by error, omission,or negligence in performance of such insured's professional services orbased on a claimed performance of professional services without consent, uponfinal disposition of the action.

      (b)   Reports of the information required bysubsection (a) shall be filed with the stateboard of healing artsno later than 30 days following thefinal disposition of the action.

      (c)   Failure to report the information required by subsection (a) shallconstitute a violation of K.S.A. 40-1120, and amendments thereto, and shall besubject to penalties applicable thereto.
