38-1350. Jurisdiction to modifydetermination.(UCCJEA 203). Except as otherwise provided in K.S.A. 38-1351 andamendments thereto, a court of this state may not modify a child-custodydetermination made by a court of another state unless a court of this state hasjurisdiction to make an initial determination under subsection (a)(1) or (2) ofK.S.A. 38-1348 and amendments thereto, and:
(1) The court of the other state determines it no longer has exclusive,continuing jurisdiction under K.S.A. 38-1349 and amendments thereto, or thata court of this state would be a more convenient forum under K.S.A. 38-1354 and amendments thereto; or
(2) a court of this state or a court of the other state determines thatthe child, the child's parents, and any person acting as a parent do notpresently reside in the other state.
