25-4305. Recall of state officers; application;deposit; filing, when.The recall of a state officer, except the secretary of state, is proposedby filing an application with the secretary of state. The recall of thesecretary of state is proposed by filing an application with the lieutenantgovernor, who shall perform the duties imposed on the secretary of statein the recall of other state officers. A deposit of $100 must accompanythe application. This deposit will beremitted tothe state treasurer, in accordance with the provisions of K.S.A. 75-4215, andamendments thereto. Upon receipt of each such remittance, the state treasurershall deposit the entire amount inthe state treasury to the credit of the state general fund if a petitionis not properly filed. If a petition is properly filed the deposit shallbe refunded. No application for the recall of a state officer may be filedduring the first 120 days or thelast 200 days of the term of office of such officer.
