261.123 WRITTEN AGREEMENT.
1. An individual served with notice pursuant to section 261.121
may enter into a written agreement with the commission for payment of
the obligation owed by the individual. The agreement shall take into
consideration the individual's ability to pay and other criteria
established by rule of the commission. The written agreement shall
include all of the following:
a. The method, amount, and dates of payments by the
individual.
b. A statement that upon breach of the written agreement by
the individual, the commission shall issue a certificate of
noncompliance to any appropriate licensing authority.
c. A written agreement entered into pursuant to this
subsection does not preclude any other remedy provided by law.
2. If the individual enters into a written agreement with the
commission following issuance of a certificate of noncompliance, the
commission shall issue a withdrawal of the certificate of
noncompliance and shall forward a copy of the withdrawal by regular
mail to the individual and any appropriate licensing authority. Section History: Recent Form
