123.129 CLASS "C" APPLICATION. 1. For purposes of this section: a. "Grocery store" means any retail establishment, the business of which consists of the sale of food, food products, or beverages for consumption off the premises. b. "Pharmacy" means a drug store in which drugs and medicines are exposed for sale and sold at retail, or in which prescriptions of licensed physicians and surgeons, dentists, or veterinarians are compounded and sold by a registered pharmacist. 2. A class "C" permit shall not be issued to any person except the owner or proprietor of a grocery store or pharmacy. 3. A class "C" permit shall be issued by the administrator to any person who is the owner or proprietor of a grocery store or pharmacy, who: a. Submits a written application for such permit, which application shall state under oath all the information required of a class "A" applicant by section 123.127, subsection 1, paragraph "a". b. Establishes that the person is of good moral character as defined by this chapter. c. Consents to inspection as required in section 123.30, subsection 1. d. States the number of square feet of interior floor space which comprises the retail sales area of the premises for which the permit is sought.Section History: Early Form
