633.126 - DEFINITIONS.

        633.126  DEFINITIONS.         1.  "Common trust fund" means a fund maintained by a bank or      trust company exclusively for the collective investment and      reinvestment of moneys contributed thereto by that bank or trust      company, or by another bank or trust company at least eighty percent      of the voting stock of which is owned or controlled by a bank holding      company which owns or controls at least eighty percent of the voting      stock of the bank or trust company maintaining the common trust fund,      in its capacity as a fiduciary or cofiduciary.         2.  "Fiduciary", for the purposes of this section and sections      633.127 to 633.129, means acting in any of the following capacities,      namely:  testamentary trustee appointed by any court, trustee under      any written agreement, declaration or instrument of trust, executor,      administrator, guardian, or conservator, custodian under chapter      565B, or other capacity permitted under any state or federal law or      regulation governing collective investment funds maintained by a bank      or trust company.
