        524.1001  POWER TO ACT AS FIDUCIARY.         When approving a proposed state bank, or at any time subsequent      thereto upon amendment of its articles of incorporation, the      superintendent may authorize a state bank to act in a fiduciary      capacity.  In determining whether the superintendent shall authorize      a state bank to act in a fiduciary capacity, the superintendent may      consider any of the relevant criteria referred to in section 524.305,      and other appropriate facts and circumstances.  In any fiduciary      capacity in which a state bank may act pursuant to this section, it      shall have all the rights and duties which an individual has in such      capacity under applicable law and under the terms upon which the      state bank is designated to act in such capacity.  In authorizing a      state bank to act in a fiduciary capacity, the superintendent may      limit such authorization to such capacities as the superintendent      deems appropriate.
