        468.344  CONDEMNATION OF RIGHT OF WAY.         When in the judgment of the board of supervisors, it is      inadvisable to establish a drainage district but necessary to acquire      right of way through private lands for the construction of ditches or      drains as outlets for the drainage of highways, the board of      supervisors may cause such right of way to be condemned by      proceedings in the manner required for the exercise of the right of      eminent domain as for works of internal improvement, except that no      attorney fee shall be taxed, and pay the costs and expense of such      condemnation from either or both of said secondary road funds.
