459.314 - APPLICATION OF MANURE NEAR DESIGNATED AREAS.

        459.314  APPLICATION OF MANURE NEAR DESIGNATED      AREAS.         1.  The department shall adopt rules relating to the application      of manure in close proximity to a designated area.         2.  Except as otherwise provided in this subsection, a person      shall not apply manure on land located within two hundred feet from a      designated area, unless one of the following applies:         a.  The manure is land-applied by injection or incorporation      on the same date as the manure was land-applied.         b.  An area of permanent vegetation cover, including filter      strips and riparian forest buffers, exists for fifty feet surrounding      the designated area other than an unplugged agricultural drainage      well or surface intake to an unplugged agricultural drainage well,      and the area of permanent vegetation cover is not subject to manure      application.         c.  The department adopts rules requiring an increased      separation distance for the application of manure located in      proximity to a high-quality water resource in order to protect the      integrity of the high-quality water resource.  However, the      department shall not provide for an increased separation distance      requirement that is more than four times the separation distance      requirement otherwise applicable under this section.
