455B.213 - CERTIFICATION OF OPERATORS.

        455B.213  CERTIFICATION OF OPERATORS.         1.  By director.  The director shall certify persons as to      their qualifications to supervise the operation of treatment plants      and water distribution systems after considering the recommendations      of the commission.         2.  Applications.  Applications for certification shall be on      forms prescribed and furnished by the department and shall not      contain a recent photograph of the applicant.  An applicant is not      ineligible for certification because of age, citizenship, sex, race,      religion, marital status, or national origin although the application      may require citizenship information.  The director may consider the      past felony record of an applicant only if the felony conviction      relates directly to the practice of operation of waterworks or      wastewater works.  Character references may be required, but shall      not be obtained from certificate holders.         3.  Disclosure of confidential information.  An employee of      the department shall not disclose information relating to the      following:         a.  Criminal history or prior misconduct of the applicant.         b.  Information relating to the contents of the examination to      persons other than members of a board of certification of another      state or their employees or an employee of the department.         c.  Information relating to the examination results other than      final scores except for information about the results of an      examination which is given to the person who took the examination.         4.  Violation.  An employee of the department who willfully      communicates or seeks to communicate such information, and a person      who willfully requests, obtains, or seeks to obtain such information,      is guilty of a simple misdemeanor.         A member of the commission who willfully communicates or seeks to      communicate such information, and any person who willfully requests,      obtains, or seeks to obtain such information, is guilty of a public      offense which is punishable by a fine not exceeding one hundred      dollars or by imprisonment in the county jail for not more than      thirty days.
