425.33 RENT INCREASE -- REQUEST AND ORDER FOR REDUCTION. If upon petition by a claimant the department of revenue determines that a landlord has increased the claimant's rent primarily because the claimant is eligible for reimbursement under this division, the department of revenue shall request the landlord by mail to reduce the rent appropriately. In determining whether a landlord has increased a claimant's rent primarily because the claimant is eligible for reimbursement under this division, the department of revenue shall consider the following factors: 1. The amount of the increase in rent. 2. If the landlord operates other rental property, whether a similar increase was imposed on the other rental property. 3. Increased or decreased costs of materials, supplies, services, and taxes in the area. 4. The time the rent was increased. 5. Other relevant factors in each particular case. If the landlord fails to comply with the request of the department of revenue within fifteen days after the request is mailed by the department, the department of revenue shall order the rent reduced by an appropriate amount.Section History: Early Form
