Chapter 9. General Provisions Relating to Establishing LegislativeDistricts

Terms and references to geographic units
Sec. 1. All terms and references to geographic units made in thedescriptions of districts in this article:
(1) have the same meanings as the terms have when used by theUnited States Department of Commerce, Bureau of the Census,in reporting the 2000 decennial census of Indiana assupplemented by geographic information compiled anddocumented by the legislative services agency; and
(2) describe the same geographical boundaries as depicted bymaps included in the GIS.

"District" defined
Sec. 2. As used in this chapter, "district" refers to a districtdescribed in IC 2-1-10 or IC 2-1-11.

"GIS" defined
Sec. 3. As used in this chapter, "GIS" refers to the geographicinformation system maintained by the office that contains thefollowing information:
(1) Geographic and population information provided in theofficial census report to the state by the United StatesDepartment of Commerce, Bureau of the Census, in reportingthe 2000 decennial census of Indiana.
(2) Election history and supplemental geographic informationcompiled by the legislative services agency.

"House district" defined
Sec. 4. As used in this chapter, "house district" refers to a districtof the house of representatives of the general assembly described inIC 2-1-10.

"Office" defined
Sec. 5. As used in this chapter, "office" refers to the office ofcensus data of the legislative services agency.

"Senate district" defined
Sec. 6. As used in this chapter, "senate district" refers to a districtof the senate of the general assembly described in IC 2-1-11.

Resolution of inconsistent inclusions in house or senate districts
Sec. 7. (a) Any part of Indiana that has not been described asincluded in a house or senate district is included within the house orsenate district that:
(1) is contiguous to the part; and
(2) contains the least population of all house or senate districtscontiguous to that part according to the 2000 decennial censusof Indiana.
(b) If any part of Indiana is described as being in more than one(1) house or senate district, the part is included within the house orsenate district that:
(1) is one (1) of the house or senate districts in which the partis listed in IC 2-1-10 or IC 2-1-11, whichever is applicable;
(2) is contiguous to the part; and
(3) contains the least population according to the 2000decennial census of Indiana.
(c) If any part of Indiana:
(1) is described in IC 2-1-10 or IC 2-1-11 as being in one (1)house or senate district; and
(2) entirely surrounded by another house or senate district;
the part shall be incorporated into the house or senate district thatsurrounds the part.
(d) If any part of Indiana:
(1) is described as being in one (1) house or senate district; and
(2) is not contiguous to another part of the house or senatedistrict that contains the majority of the population in the houseor senate district;
the part is included with the contiguous house or senate district thatcontains the least population according to the 2000 decennial censusof Indiana.

Treatment of geographic slivers
Sec. 7.5. (a) As used in this section, "geographic sliver" means apolygon contained in the GIS resulting from the overlay of anexisting geographic data set onto a more recent version of thatgeographic data set.
(b) A geographic sliver is considered to be included in thedescription of the larger unit of geography to which the geographicsliver belongs within the same geographic data set.
(c) If this article provides that a district includes a unit ofgeography in Indiana, that district contains any geographic slivers
included in that unit of geography under subsection (b).

Number of house districts
Sec. 8. Indiana is divided into one hundred (100) house districtsas described in IC 2-1-10. From each of these districts there shall beelected one (1) representative of the house of representatives of theIndiana general assembly.

Number of senate districts; effect of redistricting on senatorselected in 2000
Sec. 9. (a) Indiana is divided into fifty (50) senate districts asdescribed in IC 2-1-11. From each of these districts there shall beelected one (1) senator of the senate of the Indiana general assembly.
(b) Each senator elected in the general election in 2000 for a fullfour (4) year term shall continue to hold office until the term forwhich the senator was elected has expired by limitation, and thesenator shall represent the district established under IC 2-1-11 inwhich the senator's legal residence is located.

Maintenance of census descriptions and maps
Sec. 10. The legislative services agency shall separately maintainand preserve in the GIS the descriptions and maps included in the2000 decennial census of Indiana. The legislative services agencyshall make those descriptions and maps available for publicinspection during regular office hours and on the Internet.

Incorporation of census report and documents
Sec. 11. The official report and all official documents relating tothe report of the 2000 decennial census are incorporated by referenceinto this article.

Office modifications to GIS
Sec. 12. The office shall make modifications in the GIS necessaryto conform the GIS to the rules stated in section 7 and section 7.5 ofthis chapter.
