Chapter 17. Mussels License

"Resident" defined
Sec. 1. As used in this chapter, "resident" means a person who:
(1) has continuously resided in Indiana for at least three
hundred sixty-five (365) consecutive days immediately before
applying for a license under this chapter; and
(2) possesses:
(A) an Indiana motor vehicle operator's license; or
(B) an identification card;
issued by the bureau of motor vehicles.

License requirement
Sec. 2. A person may not:
(1) take mussels or mussel shells from the water of the state; or
(2) ship, offer to sell, buy, or offer to buy mussels or mussel
shells taken from the water of the state;
without having a license issued by the department.

Issuance; fees
Sec. 3. The department may issue the following license to take,
ship, sell, buy, or export mussels or mussel shells taken from the
water of the state under rules adopted under IC 4-22-2 for the
protection of mussels and upon payment of the following applicable
license fees:
(1) A resident yearly license to take, ship, and sell mussels or
mussel shells, one hundred dollars ($100).
(2) A resident yearly license to buy, ship, sell, or export mussels
or mussel shells, one thousand five hundred dollars ($1,500).
(3) A nonresident yearly license to buy, ship, sell, or export
mussels or mussel shells, five thousand dollars ($5,000).

Violations
Sec. 4. A person who violates section 2 of this chapter commits
a Class A misdemeanor.
