(30 ILCS 785/5)
Sec. 5. Definitions. In this Act:
"Grantee" means any qualified public, private, or not‑for‑profit agency or individual, including, but not limited to, a college, university, hospital, laboratory, research institution, local health department, voluntary health agency, health maintenance organization, corporation, student, fellow, or entrepreneur, conducting clinical research using State funds. A grantee may also be a corporation that is headquartered in Illinois and that conducts research using State funds.
"Minority group" means a group that is a readily identifiable subset of the U.S. population that is distinguished by racial, ethnic, or cultural heritage. The following racial and ethnic categories shall be used as guidelines:
(1) "American Indian or Alaskan Native" means a |
| person having origins in any of the original native peoples of North America and who maintains a cultural identification through tribal affiliation or community recognition. | |
(2) "Asian or Pacific Islander" means a person having |
| origins in any of the original peoples of the Far East, Southeast Asia, the Indian subcontinent, or the Pacific Islands, including, but not limited to, China, India, Japan, Korea, the Philippine Islands, and Samoa. | |
(3) "Black" means someone not of Hispanic origin |
| having origins in any of the black racial groups of Africa. | |
(4) "Hispanic" means a person of Mexican, Puerto |
| Rican, Cuban, Central or South American, or other Spanish culture or origin, regardless of race. | |
"Project of clinical research" includes a clinical trial.

Sec. 10. Inclusion of women and minorities. Except as provided in Section 15 or 30, in conducting or supporting a project of clinical research, a grantee must do all of the following:
(1) Ensure that women, including, but not limited |
| to, women over the age of 40 years, are included as subjects in each research project. | |
(2) Ensure that members of minority groups are |
| included as subjects in each research project. | |
(3) Conduct or support outreach programs for the |
| recruitment of women and members of minority groups as subjects in projects of clinical research. | |
(4) Comply with the National Institutes of Health |
| Guidelines on the Inclusion of Women and Minorities in Clinical Research. | |
