53-8-33. (Pre-1998 Probate Code) Sale of stock or personalty of corporation; petition; citation and hearing; manner of sale
Except as otherwise provided in Code Section 53-8-37, whenever any administrator or executor, unless authorized to sell by the provisions of the will which he is executing, desires to sell stocks or other securities of any corporation or other personal property, he shall first apply to the judge of the probate court of the county which has jurisdiction over him for leave to sell the stock, which application shall be heard and determined, after the usual citation for leave to sell is issued, as are applications for the sale of real property. After the sale is ordered, the sale of the stocks or other personal property shall be conducted in the same manner as sales of real property are conducted.
