O.C.G.A. 53-6-143 (2010)
53-6-143. (Pre-1998 Probate Code) Commissions for delivering property in kind; amount; additional compensation for land worked by trustee
Commissions may be allowed to any administrator or executor for delivering over any property in kind. The judge of the probate court, in his discretion, may allow reasonable compensation for such service, not exceeding 3 percent of the appraised value and, in cases where there has been no appraisement, not over 3 percent of the fair value as found by the judge; the allowances shall be made irrespective of whether delivery over in kind is made pursuant to proceedings for that purpose in the probate court and irrespective of whether the property, except money, is tangible or intangible, personal or real. If, however, land is worked by any trustee for the benefit of the parties in interest, the judge may, in his discretion, allow to the trustee additional compensation for such services, in no case exceeding 10 percent of the annual income of the property so managed.
