53-6-52. (Pre-1998 Probate Code) Appointment by superior court of new trustee to serve in place of trustee engaged in war service; petition and notice


Whenever any trustee is engaged in war service, the remaining trustee, if any, or any other person interested in the trust fund or trust estate may petition the superior court of the county wherein the trustee resides or of the county wherein one or more beneficiaries of the trust resides for the appointment of a new trustee in place of the trustee engaged in war service; and, upon notice to such persons as the court shall direct, in a summary manner, the court shall have full power and authority to appoint a new trustee to serve in place of the trustee engaged in war service, with all the authority and subject to all the pains and penalties of the trustee engaged in war service.
