53-2-97. (Pre-1998 Probate Code) Time at which general legacy bears interest
(a) A general legacy usually bears interest after the expiration of 12 months from the death of the testator. However, when the condition of the estate at that time, as to the payment of debts and legacies, is doubtful, or the fund out of which the legacy is to be paid is unavailable for all the charges made upon it, or any other equitable circumstance intervenes, the general rule yields to the equity and necessity of the particular case.
(b) A general legacy to be paid at a future time or upon a future event bears no interest until such time or event.
