§ 53-2-106 - (Pre-1998 Probate Code) Effect of substitution of property bequeathed or devised for other of like character

53-2-106. (Pre-1998 Probate Code) Effect of substitution of property bequeathed or devised for other of like character


If the testator exchanges the property bequeathed or devised for other property of like character or merely changes the investment of a fund bequeathed, the law deems the intention to be to substitute the one for the other, and the legacy or devise shall not fail.
