Sec. 47-46. Payment for fence between agricultural property and state highway. When there is no fence between property used for agricultural purposes adjoining
a state highway and the highway property sufficient for the purposes of section 47-43,
or when any fence so located is in need of replacement, the adjoining proprietor may,
with the written agreement of the Commissioner of Transportation, executed within
sixty days of a written request by such proprietor, cause such a fence to be constructed
or replaced within two years from the date of the agreement; and the Commissioner of
Transportation shall, within sixty days after the construction or replacement is completed, reimburse the proprietor for one-half the cost thereof, subject to limitations of
costs per linear foot and in accordance with standards to be established by said commissioner.
