Sec. 22-61. Penalty. Any person who violates any provision of this chapter shall
be fined not more than one hundred dollars for the first offense and not more than two
hundred and fifty dollars for each subsequent similar offense. No prosecution under this
chapter shall be instituted without first having given the defendant an opportunity to
appear before said commissioner or his authorized agent to introduce evidence, either
in person or by agent or attorney, at a private hearing. If, after such hearing, or without
such hearing in case the defendant or his agent or attorney fails to appear, the commissioner is of the opinion that the evidence warrants prosecution, he shall make complaint
to the proper prosecuting officer. After judgment by the court in any case arising under
this chapter, said commissioner may publish any information pertinent to the issuance
of the judgment by the court in such form as he designates from time to time.
