Sec. 14-49b. Registration renewal fee. (a) For each new registration or renewal
of registration of any motor vehicle with the Commissioner of Motor Vehicles pursuant
to this chapter, the person registering such vehicle shall pay to the commissioner a fee
of ten dollars for registration for a biennial period and five dollars for registration for
an annual period, except that any individual who is sixty-five years of age or older on
or after January 1, 1994, may, at the discretion of such individual, pay the fee for either
a one-year or two-year period. The provisions of this section shall not apply with respect
to any motor vehicle which is not self-propelled, which is electrically powered, or which
is exempted from payment of a registration fee. This fee may be identified as the "federal
Clean Air Act fee" on any registration form provided by the commissioner. Payments
collected pursuant to the provisions of this section shall be deposited as follows: (1)
Fifty-seven and one-half per cent of such payments collected shall be deposited into the
Special Transportation Fund established pursuant to section 13b-68, and (2) forty-two
and one-half per cent of such payments collected shall be deposited in a treasurer's
account and credited to a separate, nonlapsing federal Clean Air Act account which
shall be established by the Comptroller within the General Fund. The federal Clean
Air Act account may be used to pay any costs to state agencies of implementing the
requirements of the federal Clean Air Act Amendments of 1990 that are not otherwise
met by the fees collected pursuant to section 22a-174 and any funds transferred to the
account pursuant to section 22a-27m may additionally be used by the Commissioner
of Environmental Protection to carry out the provisions of chapter 446c. All moneys
deposited in this account are deemed to be appropriated for this purpose. The fee required
by this section is in addition to any other fees prescribed by any other provision of this
title for the registration of a motor vehicle.
(b) The Commissioner of Environmental Protection, in consultation with the Commissioner of Motor Vehicles, shall annually, within ninety days prior to the beginning
of the next ensuing fiscal year, submit to the Secretary of the Office of Policy and
Management an annual operating budget for the federal Clean Air Act account, providing for the operation of programs to implement the federal Clean Air Act Amendments
of 1990, to the extent that the payment of such costs has not otherwise been adequately
provided for. Such annual operating budget shall include an estimate of revenues from
the fees and charges fixed by law, and from any and all other sources, to meet the
estimated expenditures of the federal Clean Air Act account for such fiscal year. Within
thirty days prior to the first day of such fiscal year the Secretary of the Office of Policy
and Management shall approve said annual operating budget, with such changes, amendments, additions and deletions as shall be agreed upon prior to that date by the Commissioner of Environmental Protection and the Secretary of the Office of Policy and Management.
