Sec. 10a-109o. Jurisdiction of Superior Court. Performance of governmental
function. (a) The Superior Court shall have jurisdiction to enter judgment against the
university founded upon any express contract, including any indemnification provision
thereof, between the university and the purchasers and subsequent owners and transferees of securities issued or contracted to be issued by the university, or between the
university and any other parties to any financing documents entered into, pursuant to
sections 10a-109a to 10a-109y, inclusive. Any action brought under this section shall
be brought in the superior court for the judicial district of Hartford. The jurisdiction
conferred upon the Superior Court by this section includes any set-off, claim or demand
whatever on the part of the university against any plaintiff commencing an action under
this section. Such action shall be tried to the court without a jury. All legal defenses
except governmental immunity shall be reserved to the university. Any action brought
under this section shall be privileged in respect to assignment for trial upon motion of
either party.
(b) The carrying out by the university of the powers and duties conferred upon it
by sections 10a-109a to 10a-109y, inclusive, shall be deemed to be the performance of
an essential governmental function. Sections 10a-109a to 10a-109y, inclusive, shall in
no way limit or restrict the power and authority of the state to borrow money for the
benefit of the university.
