27-87-401. Regulation -- Fines.

(a) The toll of ferries that are established shall at all times be subject to regulation by the county court in which the ferry may be kept.

(b) Every keeper of a ferry shall keep constantly posted in some conspicuous place at the ferry the rates of toll allowed to be charged. If any ferrykeeper fails or neglects to do so, he shall forfeit and pay the sum of four dollars ($4.00) for every neglect. Each day that the ferry rates are not posted shall constitute a separate offense. The sum shall be recovered in a civil action before any justice of the county, one-half (1/2) for the use of the prosecutor and one-half (1/2) to the county.

(c) Should any keeper presume to charge or demand more than what the county court may have allowed, the keeper shall forfeit and pay for every offense the sum of ten dollars ($10.00), to be recovered before any justice of the peace of the township in which such ferry is located by any person of whom the demand may be made.
