27-51-214. Penalties for speeding in school zone.
Any person who violates any of the provisions of 27-51-212 or 27-51-213 shall, upon conviction, be guilty of a misdemeanor and shall be punished as follows:
(1) For a first conviction, an offender shall be punished by a fine of not less than twenty-five dollars ($25.00) nor more than one hundred dollars ($100) or by imprisonment in the county jail for not less than one (1) day nor more than ten (10) days, or by both fine and imprisonment;
(2) (A) For a conviction of a second violation within one (1) year, an offender shall be punished by a fine of not less than fifty dollars ($50.00) nor more than two hundred fifty dollars ($250) or by imprisonment in the county jail for not less than five (5) days nor more than twenty-five (25) days, or both fine and imprisonment; and
(B) In addition, the Office of Driver Services of the Revenue Division of the Department of Finance and Administration shall suspend the driving privilege of the person for a period of six (6) months upon receipt of notice of a final conviction;
(3) (A) For a conviction of a third or subsequent violation within one (1) year, an offender shall be punished by a fine of not less than two hundred fifty dollars ($250) nor more than one thousand dollars ($1,000) or by imprisonment in the county jail for not less than twenty-five (25) days nor more than six (6) months, or both fine and imprisonment; and
(B) In addition, the office shall suspend the driving privilege of the person for a period of one (1) year upon receipt of notice of a final conviction.
