When a petition, signed by not less than ten per cent of the lawful voters of the city or town, as shown by the last regular municipal election, is filed with the governing body requesting that the proposition: "Shall a tax of not exceeding one mill be levied each year for the purpose of furnishing a band fund?" be submitted to the voters, the governing body shall cause the question to be submitted to the voters of the city or town at the next general municipal election. C. If a majority of the votes cast at the election is in favor of the proposition, the governing body shall levy the tax. D.
