36-2912.02. Qualified commercial carriers; healthcare group contracts; definition A. Notwithstanding any law to the contrary, the director may issue a request for proposal and contract with an accountable health plan to provide services to persons who are eligible pursuant to section 36-2912. The contract must include the same requirements in section 36-2912 that must be met by healthcare group contractors and must specify the minimum requirements for a performance bond, equity requirements, other financial reserves deemed necessary by the administration and any other financial, programmatic and operational requirements that must be met by the accountable health plan. The administration shall monitor compliance and enforce the requirements prescribed by the contract and this section. B. An accountable health plan that contracts with the administration to provide healthcare group services must comply with the administration's contract requirements and the requirements of this article that are applicable to healthcare group contractors. C. To the extent that services are provided pursuant to this article, the requirements of title 20 do not apply to an accountable health plan. D. An accountable health plan is not required to be a contractor or establish an affiliated corporation as prescribed in section 36-2906.01. E. For the purposes of this section, "accountable health plan" has the same meaning prescribed in section 20-2301. |
