13-4081. Undertaking by witnesses If there is a pending criminal prosecution or a grand jury investigation that has commenced or is about to commence, a magistrate may require each material witness for the state, and each material witness for the defendant if so requested by him, to enter into a written undertaking to appear and testify in the criminal prosecution or grand jury investigation or to forfeit such amount as the magistrate fixes. |
