2532.10—Military Installation Conversion Demonstration programs.
(a) Purposes.
The purposes of this section are to: (1) Provide direct and demonstrable service opportunities for economically disadvantaged youth;
(3)
Encourage communities affected by such closures or realignments to convert the installations to community use; and
(b) Definitions.
As used in this section: (1) Affected military installation. The term affected military installation means a military installation described in section 325(e)(1) of the Job Training Partnership Act (29 U.S.C. 1662d(e)(1) ).
(3) Convert to community use.
The term convert to community use, used with respect to an affected military installation, includes—
(ii)
Carrying out, at the installation, a construction or economic development project that is of substantial benefit, as determined by the Chief Executive Officer, to—
(B)
A community located within 50 miles of the installation or such further distance as the Chief Executive Officer may deem appropriate on a case-by-case basis.
(4) Demonstration program.
The term demonstration program means a program described in paragraph (c) of this section.
(c) Demonstration programs—
(1) Grants—
The Corporation may make grants to communities and community-based agencies to pay for the Federal share of establishing and carrying out military installation conversion demonstration programs, to assist in converting to community use affected military installations located—
(2) Duration.
In carrying out such a demonstration program, the community or community-based agency may carry out—
(d) Use of Funds—
(1) Stipend.
A community or community-based agency that receives a grant under paragraph (c) of this section to establish and carry out a project through a demonstration program may use the funds made available through such grant to pay for a portion of a stipend for the participants in the project.
(2) Limitation on amount of stipend.
The amount of the stipend provided to a participant under paragraph (d)(1) of this section that may be paid using assistance provided under this section and using any other Federal funds may not exceed the lesser of—
(i)
85 percent of the total average annual subsistence allowance provided to VISTA volunteers under section 105 of the Domestic Volunteer Service Act of 1973 (42 U.S.C. 4955 ); and
(e) Participants—
(1) Eligibility.
A person will be eligible to be selected as a participant in a project carried out through a demonstration program if the person is—
(ii)
In the case of a full-time summer program, economically disadvantaged and between the ages of 14 and 24; or
(iii)
An eligible youth as described in section 423 of the Job Training Partnership Act (29 U.S.C. 1693 ).
(2) Participation.
Persons desiring to participate in such a project must enter into an agreement with the sponsor of the project to participate—
(f) Application—
(1) In general.
To be eligible to receive a grant under paragraph (c) of this section, a community or community-based agency must submit an application to the Chief Executive Officer at such time, in such manner, and containing such information as the Chief Executive Officer may require.
(A)
Provide preservice and inservice training, for supervisors and participants, that will be conducted by qualified individuals or qualified organizations;
(iv)
An assurance that the applicant will comply with the nonduplication, nondisplacement and grievance procedure provisions of part 2540 of this chapter.
(g) Limitation on Grant.
In making a grant under paragraph (c) of this section with respect to a demonstration program to assist in converting an affected military installation, the Corporation will not make a grant for more than 25 percent of the total cost of the conversion.
