45.20—What supporting information must a bureau provide with its preliminary conditions or prescriptions?
(a) Supporting information.
(1)
When any bureau files a preliminary condition or prescription with FERC, it must include a rationale for the condition or prescription and an index to the bureau's administrative record that identifies all documents relied upon.
(2)
If any of the documents relied upon are not already in the license proceeding record, the bureau must:
(iii)
In the case of a condition developed by the Bureau of Indian Affairs, provide copies to the affected tribe.
(b) Service.
In addition to serving a copy of its preliminary condition or prescription on each license party, the bureau must provide a copy to OEPC if and when a request for a hearing is filed with respect to the preliminary condition or prescription.
