102-75.905—When must the disposal agency prepare an explanatory statement?
The disposal agency must prepare an explanatory statement of the circumstances of each of the following proposed disposals by negotiation:
(a)
Any real property that has an estimated fair market value in excess of $100,000, except that any real property disposed of by lease or exchange is subject only to paragraphs (b) through (d) of this section.
(b)
Any real property disposed of by lease for a term of 5 years or less, if the estimated fair annual rent is in excess of $100,000 for any of such years.
(c)
Any real property disposed of by lease for a term of more than 5 years, if the total estimated rent over the term of the lease is in excess of $100,000.
(d)
Any real property or real and related personal property disposed of by exchange, regardless of value, or any property disposed in which any part of the consideration is real property.
