3010.6—Type 3 adjustment—in general.
(a)
A Type 3 rate adjustment is a request for an exigency-based rate adjustment. It is authorized only when justified by exceptional or extraordinary circumstances.
(b)
An exigency-based rate adjustment is not subject to the inflation-based limitation or the restrictions on the use of unused rate adjustment authority, and does not implement a negotiated service agreement.
(c)
A Postal Service request for a Type 3 rate adjustment is subject to public participation and Commission review within 90 days.
