77.33—Initiation of studies.
(a)
An aeronautical study is conducted by the FAA:
(1)
Upon the request of the sponsor or any construction or alteration for which a notice is submitted under subpart B of this part, unless that construction or alteration would be located within an antenna farm area established under subpart F of this part; or
(2)
Whenever the FAA determines it appropriate.

§ 77.33
Effective period of determinations.
(a)
A determination issued under this subpart is effective 40 days after the date of issuance, unless a petition for discretionary review is received by the FAA within 30 days after issuance. The determination will not become final pending disposition of a petition for discretionary review.
(b)
Unless extended, revised, or terminated, each Determination of No Hazard to Air Navigation issued under this subpart expires 18 months after the effective date of the determination, or on the date the proposed construction or alteration is abandoned, whichever is earlier.
(c)
A Determination of Hazard to Air Navigation has no expiration date.
