1264.3—Housing associate eligibility requirements.
(a) General.
A Bank may certify as a housing associate any applicant that meets the following requirements, as determined using the criteria set forth in § 1264.4 :
(1)
The applicant is approved under title II of the National Housing Act (12 U.S.C. 1707, et seq. );
(4)
The principal activity of the applicant in the mortgage field consists of lending its own funds; and
(b) State housing finance agencies.
In addition to meeting the requirements in paragraph (a) of this section, any applicant seeking access to advances as a SHFA pursuant to § 950.17(b)(2) of this title shall provide evidence satisfactory to the Bank, such as a copy of, or a citation to, the statutes and/or regulations describing the applicant's structure and responsibilities, that the applicant is a state housing finance agency as defined in § 1264.1.
